Marjorie the best way to convict yourself.
In the case of Marjorie Knoeller and Robert Noel, their two dogs fatally mauled a woman in there apartment building in San Francisco. In that apartment building dogs were not allowed and this breed "prescanario" these dogs are super aggressive and are huge. These dogs weigh between 120-140 pounds which is more than some people in America. Let alone these dogs are extremely powerful. While Diane Whipple was coming home about to get into her 6th floor apartment when Marjorie lost control of these dogs who ended up completely mauling her and leaving a murder like scene on the floor. Diane and Robert in the aftermath of this case start talking crazy to the media who was already outraged at them for having such vicious dogs. The couple claimed no responsibility for their negliegence. Marjorie denied the claim that she "could not control the dogs", she also blamed the attack on the fact that Diane was "on her period" and she instigated it with her perfume. These claims made the public hate the wits out of this couple. Also to make matters worse Robert was baiting the District Attorney when he was asked if it would surprise him if he would be surprised if he was arrested it. When the District attorney put them up for indictment the grand jury indicted Marjorie on murder and involuntary manslaughter. This is because they had an extreme confirmation bias against Marjorie due to her instigating, reckless talk in the media. In my opinion the best that this couple could have done would have been to apologize for the loss of Diane and shut up.. The public opinion on this couple was the reason why they were convicted of these crimes. "They played themselves" literally, basically opened the jail cell for themselves. If they had shut their mouths they would have just been sued in a civil court this would have never escalated this far criminally. They were literally holding press conferences, talking out of their ass like they were Lavar Ball. In the first place this couple should have never had a dog in this building let alone two 120 lb. prescanario attack dogs.
Next, I do not support Marjorie's conviction for second degree murder because she did not go out that day wanting Diane to die she was just grossly negligent and dumb. I say this because she made a bad decision to adopt these dogs that were sold by a 39 year old convict who was serving life in prison and a member of the Aryan Brotherhood.
Secondly, the trial was not fair at all. The defense attorney was very tramatic in her opening statements and did not make a good argument proclaiming Marjorie's innocence. Also, during the trial the prosecutor brought up the fact that the couple had adopted a Aryan Brotherhood member for their family even though they were married. This played into the jury member's bias's and was not relevant to the case. Lastly, during the closing statements the prosecutor asked the jurors to put themselves in the shoes of Diane which is an extreme closing argument. During this time the judge stopped Ruiz from objecting to the closing argument which shows judge bias.
I think both of them serving 3-4 years for this crime is enough, and I think the murder conviction should be overturned. This should have been a civil matter in the first place.
Don't spend my tax payer dollars on to put Marjorie away but rather make her pay the price in civil court for her gross negligence.

One part of this case I find particularly interesting is that the jury's decision to find Marjorie Knoller guilty of second degree murder was actually overturned by a judge. I think this case was an example of the justice system functioning properly because there did seem to be enough evidence proving that Knoller and Noel should be found guilty of manslaughter but not enough evidence proving that the couple should be found guilty of second degree murder. However, the judge’s reversal of the jury decision illustrates how there is always room for controversy regarding the justice system and understandably is a reason for some people’s lack of faith in the system. I agree that Knoller and Noel certainly showed poor moral judgment in the aftermath of the attack by trying to shift the blame onto Diane Whipple, who was clearly an innocent victim, and refusing to apologize. Nevertheless, second degree murder implies that Knoller genuinely knew what her dogs were about to do, and there was not adequate concrete evidence proving that this was the case. Although the judge’s decision to reverse the jury decision may have been questionable because it illustrates one person appearing to take the power out of the hands of the people in a case and devalues the jury, the prosecution’s case had not completely met the standard of second degree murder.
