Surrogacy
In the class discussion of the case revolving about Baby M. The argument brought up was whether Mary Beth Whitehead had the right to keep the child, even though she had signed a contract saying that she will give the couple her baby. I say that she does not have the right because she had signed a contract, which gives her no right to keep her baby. Since she signed, she has to give it to the lady and man who were waiting for this baby. If you were in the shoes of Elizabeth Stern, the lady that was going to have Baby M, wouldn’t you want your child? For mothers that can’t have children, they seek help from women that can, and if you were that women that couldn’t have a baby, you would want a surrogate to help. A surrogate is women that carry and has a baby for another woman. But in this case, Mary Whitehead did not exceed that expectation.
yes i agree, if she signed up to give up her child to make another family happy since they can't have children, she has to give the baby to the her. She signed a legal contract she can't really back out. She can have another child anytime she wants but there is women out in the world who sadly can't have children and who wish they could. That's why there are so many options like surrogacy or adoption.
